Background

Keeping Balance Pty Ltd ABN: 36 637 621 419 ("Keeping Balance") provides business owners support in achieving efficient day-to-day financial management by implementing systems, processes, and management strategies.

These Terms of Sale (the "Agreement"), together with our Privacy Policy and website Terms of Use, are the term and conditions that apply to your access to and use of the Keeping Balance online shop and supply of products via our website (the "Site"). 

By ordering products from the Keeping Balance online shop, you acknowledge that you have read, understood, and agree to be bound by these Terms of Sale. 

1.Products 

Keeping Balance currently offers the following educational digital products: 

  • Videos 

  • Downloadable PDFs

  • eBooks

  • Templates 

  • Spreadsheets

You may buy or download paid digital products offered online by Keeping Balance by navigating the catalogue and shopping cart available on our website.

You understand and agree: 

  • To buy products or download paid digital products via our website, you must be at least 18 years of age. 

  • You confirm that you are at least 18 years of age and that all information you provide is accurate, complete, and not misleading by placing an order.

Online sessions and access to courses

  • All Short Courses  are delivered online and can be accessed via Thrivecart Learn.

  • All modules are self-paced, self-study, and can be completed during your lifetime. 

  • For each Short Course, you may book an online session with Jahna Koehler at the price advertised online via the link provided within the Course Content. 

2. Price

  • All prices are in Australian dollars and include GST (Australian Goods and Services Tax).

  • All prices are subject to change without notice.

3. Special Offers

  • Keeping Balance may provide special offers in relation to our products from time to time. 

  • At any time, we may terminate any special offer without advance notice. 

  • If terminated, a special offer will continue to apply to products you ordered in good faith under these Terms before the special offer was terminated.

4. Payment

  • The full payment for your order will be deducted from your chosen payment method on the completion of your order. 

  • We accept payment via Stripe.

  • We do not retain or store credit card details.  

5. Refunds

  • No refunds are offered for a change of mind. 

  • Due to the digital nature of the product, refunds are not available for any purchase or download unless there is a breach of the Australian Competition and Consumer Act 2010. 

6. License (Digital Products)

  • Upon purchase of any digital product under this Agreement, including but not limited to eBooks and all PDF downloads (Digital Content), Keeping Balance grants the purchaser a perpetual, worldwide, restricted, and non-exclusive license to use such Content for personal use only.

Restrictions

  • All downloads are limited to the purchaser and the purchaser's electronic devices and must not be shared with any other third party.

7. Copyright And Intellectual Property (Trademarks)

  • All material on this Site or otherwise delivered by Keeping Balance, including hard copy books and content contained in digital downloads products such as PDF’s, video and audio recording, is subject to copyright. 

  • Modifying our Content for any other purpose violates our copyright and other proprietary rights and is strictly prohibited.  

  • You acknowledge that you do not acquire any ownership rights by using the Site or our Content.   

  • The trademarks, logos, and service marks displayed on our Site are the registered or unregistered trademarks of Keeping Balance.

  • Whether registered or unregistered, the trademarks may not be used in connection with any product or service that does not belong to Keeping Balance, in any manner that is likely to cause confusion with customers, or in any manner that disparages Keeping Balance.

  • Nothing contained on this Site should be construed as granting, by implication or otherwise, any license or right to use any trademark without our express written permission. 

  • You agree that damages may be an inadequate remedy to a breach of these Terms and acknowledge that Keeping Balance will be entitled to seek injunctive relief if such steps are necessary to prevent violations of its intellectual property rights.  

Terms of Use of Digital Content:

  • Digital Content may not be copied, shared, or otherwise distributed.

  • Content is available for personal use only.

  • Restrictions on downloads to customer devices accessing the Digital Content may apply.

  • Applicable use must be within relevant Laws.

  • Keeping Balance as the publisher of the Digital Content reserves the right to enforce applicable Terms of Use relating to the Digital Content.

Thrivecart Learn 

  • You will be required to register your details to create a password to access the Short Courses on Thrivecart Learn. 

  • Your responsibility is to ensure the details you provide are correct and current. 

Password security 

  • You are solely responsible for the protection and confidentiality of any password that may be issued to you or subscribed by you from time to time.  

  • You will not share your password with any other person. 

  • You will immediately notify us if your password is lost or becomes known to any other person. 

  • You are solely responsible for accessing and using this Site and Thrivecart Learn via your password, whether such access or use is by you or any other person.

  • The personal information you provide to the Site will be managed according to our Privacy Policy. 

Technology issues

  • Keeping Balance shall not be held responsible if there are any problems with the Site or if the host or network should go down due to circumstances beyond our control. 

  • We will do our best to get the system back up as soon as possible when it is within our control.

  • Keeping Balance shall not be liable to you or any other party because of viruses or malware that may infect your or any other party's electronic equipment. 

  • You agree that you:

    1. will not use any robot, spider or other devices, process or means to access the Short Courses;

    2. will not compromise or circumvent the security controls of the Short Courses or otherwise gain unauthorised access to the Short Courses; and 

    3. will not attempt to interfere with the proper working of the Short Courses. 

8. Alterations

  • We may alter these Terms from time to time by posting the altered version on our website. 

  • You should visit the website regularly to keep up to date with any alterations.  

  • In the case of an alteration, the altered Terms only apply to products ordered via the website after the alteration takes effect.

9. Dispute Resolution  

  • Should a concern arise between us, we strongly encourage you to contact Keeping Balance at hello@keepingbalance.com.au  to seek a resolution.  

  • Any reasonable requests will be considered and Keeping Balance will attempt to resolve the dispute through friendly mediation. 

  • Applicable Law  

  • These Terms shall be construed in accordance with and governed by the laws of the State of Queensland (QLD). 

  • You consent to the exclusive jurisdiction of the courts in the QLD to determine any matter or dispute which arises between you and Keeping Balance.

By proceeding with your purchase, you are deemed to have read, understood and agreed to the terms of your purchase under this Agreement.
